McDaniels responds to Spellman's answer to notice of intent

McDaniel received, via certified mail, Darren Spellman's answer to his filed notice of intent to recall. McDaniels stated that "other than not addressing the issues, I'm not sure of the point of the letter."  Saying that if it had been him that was required to respond, he would have highlighted his acheivements and future goals. "I find his response to be negative."

Whena sked if he was interested in running for the seat if Spellman is recalled, he stated "My primary goal is to make sure the recall takes place." Saying that if a viable candidate were to come forward he would support that person, "I ned to think what is better for the community."


He went on to say, "the community as a whole realized in a short period of time they knew a mistake had been made." Saying he had talked to over 400 people and that all he has spoken to, previous Thomas and Spellman supporters alike, were supportive of the recall efforts.

Meetings, McDaniels feels, are very important. "You need to be out there in the public" to know what is going on. Spellman had previously stated that McDaniels points to meetings not attended but Spellman pointed to meetings with Gaines, Lungren, FEMA, and others, meetings where decisions were made, or were in the formation process, that would directly affect Calaveras County.

According to the County Elections Office, the orginal number of signatures needed to circulate a petition for recall was 20. The proponenet (McDaniel) then filed a notice of intent, after this was filed, Spellman had 7 days to respond.

Both the letter of intent and the response are then required to be on every signature page of the petition for recall. The petitioner has 90 days to collect 25% of the District's registered voters' signatures (1672). The County then has 30 days to validate the signatures. Once those signatures are validated, an election must be held within 125 days of the validation.
